Point taken about the contradictory terms. However, it's understandable that if you as a military come upon ships of the enemy, you'd want to salvage as much as you can after taking them out, to reduce your own (financial) losses. I'm again drawing a parallel to ancient history: In the Napoleonian wars, the gunpowder worked well for both sides, no matter if it came from France or England. The same rule applies to Adv. Rails, or what have you (with a tip of the hat to Mr. Mynt).

Why they do not sell the ...disappropriated trade goods to further their own war effort, I do not know, I would do so, and still be disgruntled if people called me a pirate (and I think I wouldn't be wrong). However, I guess this depends quite a bit on how you look at things, especially taking into account the fact that both countries dealt out lettres de marque to privateers, in order to be able to concentrate more on the purely millitary conflict.

Wouldn't it be fun, though, to have such things (lettres de marque) implemented? An Itani-friendly pirate would go to the smurf gov't, put up some coin and get a writ that told her or him to 'burn, sink, or take as a prize' whatever Serco ships s/he might encounter?

However, the Navy captains were hell-bent on not being confused with those privateers, even though they, themselves, were like wolves among sheeps with the enemy's supply lines. Maybe there's more to what you said than first met my eye.
In the end it might boil down to the fact that wars are about property, and thus, warring nations are nothing more but pirates. Largely effective and organized, but still pirates.

Good post tosh! I suspect in this war players belonging to a warring nation are authorised to pirate ships of the opposing side implicitly and need no permission.
